The death penalty has been abolished in the EU as per the European Convention on Human Rights (ECHR) so this became a provision in the extradition treaty be India and Portugal
But technically India could give him a death penalty due to the independence of the judiciary
Portugal has gone to gr8 lengths to see that their agreement with India has been honored

IF IT’S PROVEN THAT THEY ARE GUILTY WHY NOT KILL THEM THROUGH ENCOUNTER,INSTEAD OF SENTENCING THEM FOR LIFE.
